A politician and jurist in Maryland and Pennsylvania, Tilghman was a member of the Maryland Assembly from 1788 to 1790, and of the Maryland Senate from 1791 to 1793. He was Chief Judge of the U.S. Circuit Court for Pennsylvania, 1801-1802; President Judge of Court of Common Pleas for Philadelphia District, 1805; and Chief Justice of the Pennsylvania Supreme Court, 1806 to 1827. Tilghman ran unsuccessfully for Governor of Pennsylvania as a Federalist in 1811.
